Terms & Conditions

Membership

1. Seventeen Girl Crew membership is open to Malaysian girls must be aged between 13 – 21.

2. Applications must be submitted together with a basic resume of personal details and activities and clubs that they are actively involved in.

3. Blu Inc Media shall at its own sole discretion to accept or reject any application based on the suitability of the applicant. Notification via SMS and/ or e-mail of the successful application will be sent to the member within 7 working days of application. Blu Inc Media shall not assume responsibility for any form of loss from the incorrect email address and/ or email addresses which are not updated and/or provided by the member in the Registration Form.

4. Upon successful registration, members will be given a membership card with a serial number that will be valid from the date of receipt until she reaches the age of 21 years when the card will automatically be deemed expired.

5. The Seventeen Girl Crew card is a member identification card only. The Seventeen Girl Crew card is not a charge, credit, debit or personal identification card, and therefore shall not be used as such.

6. The Seventeen Girl Crew card is not transferable and shall not be assigned to any other party. The Seventeen Girl Crew card is the property of Blu Inc Media. Any rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms & Conditions.

7. Members are deemed to have accepted and agreed to abide to the Terms & Conditions herein when applying for and/ or using the Seventeen Girl Crew card. Only one Seventeen Girl Crew membership is available per person.

8. The Seventeen Girl Crew Card is valid for use as an identity to gain access into stipulated events and to enjoy promotions provided. Benefits will be updated on Seventeen magazine’s website www.17.com.my from time to time for girl crew members, and validity period of benefits or offers will be based on information stipulated on the site.

9. In the event certain programs (i.e. internship, workshops, movie screenings etc) have limited number of seats, BluInc Media shall allocate and/or award them on a “first-come, first-serve” basis and/or at its sole discretion.

10. Special privileges, promotions and benefits afforded to members by other merchants besides Seventeen magazine shall be at the sole discretion of the merchant. The merchant will determine the conditions under which they will provide benefits and may change those conditions, after consultation with Blu Inc Media. Blu Inc Media shall not be liable for any disputes and/ or losses and expenses of any kind arising from any transactions with merchants.

Replacement of Membership Card

1. A replacement fee of RM20.00 will be charged for replacement of lost, stolen or damaged card. This fee is not refundable. If your Seventeen Girl Crew card has been lost, stolen or damaged, you must report the loss or damage to Blu Inc Media’s Marketing & Communications department at promotions1@bluinc.com.my or by calling 03-7952 7000 as soon as reasonably practiced.

2. If your Seventeen Girl Crew card is damaged, lost or stolen, Blu Inc Media will only replace the card, and shall not be bound to provide past member benefits which has been provided with the issuance of the first card.

3. Blu Inc Media shall not be responsible for any delay in replacing the old/ lost/ damaged Seventeen Girl Crew card, or for any unauthorized use of the card, or for delayed or lost correspondences, whether in the mail or otherwise or for any loss arising from the same.

GRANT OF RIGHTS

Seventeen Girl Crew members irrevocably grants Blu Inc Media the exclusive and perpetual right to:-

• videotape, film, and photograph and otherwise record interviews, statements, actions, voice and appearances including their name, voice, sound effect and likeness in connection to the program.
• to use the material for any purpose including but not limited to broadcast, exhibition, distribution, advertising, publicity, promotion, publishing, merchandising or otherwise exploited by such means and for such purposes as Blu Inc Media determines whether as part if the program or otherwise.
• to be edited, cut, rearranged, adapted, dubbed or otherwise or modified for any purposes by Blu Inc Media in its sole discretion.
• Any telecast or other exploitation of the Material or any rights therein, whether as part of the program or otherwise, will not entitle the Contestant to receive any payment.

General

1. Membership in this Programme and all related benefits are offered at the sole discretion of Blu Inc Media. Blu Inc Media reserves the rights, from time to time, to restrict, suspend or otherwise alter aspects of these Terms and Conditions with or without notice to the Members.

2. Every effort is made to ensure that information supplied to Members is correct. However, Blu Inc Media will not be held liable for any inaccuracy or erroneous description or information on the Programme and these Terms and Conditions.

3. All communications and/or correspondences done by Blu Inc Media, either via e-mail, fax, SMS, mail, advertisements and/or any other media deemed fit shall immediately supersede the previous communication and/or correspondence with regards to the same matter, unless expressed and clearly stated otherwise.

4. Any notice, communication, summary or other Programme materials to be given pursuant to these Terms and Conditions shall be sufficiently updated in the Seventeen publication on the website and/or e-mail. Members are responsible for informing Blu Inc Media of any change of name or address.

5. Blu Inc Media is the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Programme. Blu Inc Media will not be taken to have waived any of its rights when not obliged to do so under these Terms and Conditions.

6. Blu Inc Media assumes no responsibility for any loss of any nature resulting from Member participation in the Programme.

7. Blu Inc Media assumes no responsibility for any technical failure of the Programme system, self-service telephone system, e-mail system and mobile short-messaging-service system.

8. Blu Inc Media assumes no responsibility for any System malfunction and/or permanent loss of the database system due to malicious activities including but not limited to war, sabotage and/or any unfortunate events such as natural disasters affecting the System, and/or database system. As such, Blu Inc Media will not be held liable for any form of compensation regarding the above.

9. Blu Inc Media may also modify, suspend or terminate the Programme or replace it with another programme at any time. Blu Inc Media will notify any such change directly to Members.

10. The Programme terms and conditions are governed by and shall be construed in accordance with the laws of Malaysia. Members hereby expressly submit to the non-exclusive jurisdiction of the courts of Malaysia.
